Legislation
As you may be aware, this coming October 2006 there
will be changes to discrimination legislation. These changes will
relate specifically to discrimination on the basis of Age.
Recruiters have a responsibility to be aware of, and abide by, legislation
that can impact the recruitment process. It is also important to recognise
the benefits of equal opportunities employment that reflects the diversity
of our society on the grounds of race, religion, gender, age, sexual orientation
or disability.
When composing and posting job adverts, you must ensure you comply with
the following:
- The Employment Equality (Age) Regulations Act
- The Race Relations Act
- The Sex Discrimination Acts (and Equal Pay Act)
- The Disability Discrimination Act
Common Mistakes found in job descriptions:
Language Restrictions - 'Must have mother tongue English' would
imply that the job seeker must have been born in the U.K. It would be
better to specify that the job seeker should have fluent English.
Qualifications - 'Must be from a Red Brick university' would discriminate
against someone who had graduated from a university abroad. 'Must be from
a leading university' would be a better requirement. 'Must have four GCSEs'
would discriminate against someone from a country where GCSEs are not
taken. You should always state 'or equivalent' when asking for specific
qualifications.
Age - Specifying that the job seeker should be 'young', 'old' or
'mature' constitutes age discrimination, which will be illegal from October
2006. Terms like 'applicant needed to work in a young vibrant office'
should be avoided as mentioning the age group of others in the working
environment could be seen as indirectly discriminatory.
Job Titles - The job title 'Barman' should not be used. Instead,
titles like 'Bartender' or 'Barperson' should be used.
Working Environment - 'Clerk needed to work in a busy office with
predominately male staff' can be seen as indirectly discriminating and
any reference to the gender of other employees in the company should be
avoided.
